Hi, any advice for a family related BTO conflict? Is there any way that I can legally block a BTO application?

Hi, my mum passed on recently and there is a conflict regarding the 3 room flat as there are only 2 people left living inside.

My elder sister is forcing a BTO application to relocate my dad and me to a 2 room flat. Is there any way that I can legally block this application? (E.g Calling HDB / Hiring a lawyer).

My elder sister is married and no longer living with us so can I leverage this fact to block the BTO application?

My dad is the owner of the flat and wants to move but I want to stay

Sorry, I am not knowledgeable about what legal action you can take as you aren't the owner.

Could you look into the following:

  1. What is your sister trying to achieve? Unlocking the 3-room flat value? Unlock for whose usage? There are alternatives.

  2. Why does your dad want to move? Is it simply because your sister convinced him so?

  3. Is he prepared for the downsize? 2-room is a very small unit with insufficient bedrooms for you two. There is only one bathroom. Lastly, if any of you tends to make more noise (e.g. loud music), the entire house is very likely to hear it very clearly.

  4. Is he prepared, financially? If he can cash out the 3-room flat, sure. But levy and renovation costs eat into the cash.

  5. Is he prepared for the hassle of buying and selling?

  6. Can he get an ideal unit? If he moves, he will be staying for a while. He needs to calm down and be certain that he can get an ideal unit. Your dad may have BTO-ed once so I'm not sure if he can easily get an ideal unit.
