Sole custody is only granted in cases of extreme physical abuse or where parties' lack of cooperation are detrimental to the child's welfare. If there is no abuse or trauma, the Court will order joint custody to encourage both parents to cooperate over important decisions in the child's life and to co-parent with the welfare of their child in mind. The non-care & control parent will be granted access, with timings to be either agreed or decided with the child's welfare in mind. As part of the pre-divorce Mandatory Parenting Programme, co-parenting tips will be shared and you can also seek counselling support in this regard. From a child psychology and emotional perspective, it is never advisable to exclude any parent from the child's life after the divorce. I often tell my clients - there are only ex-husbands and ex-wives and there are no ex-parents.
