I wish to give up joint custody in exchange of stopping child maintenance and my ex wife is agreeable to this arrangement. Do we need to return to court on this or can a lawyer do up our agreement and that will be legal binding?

I am seeing someone with plan to remarry and set up family with her.

I would suggest that you file an application to vary the existing Order of Court, with your ex-wife consenting to the application. Better to have the agreement in the Court records.
