My Dad, a middle-manager who has been slogging for his employer of 10 years, was informed that his contract would not be renewed when he turns 62 in 3.5 months. He was offered the EAP cap of $13k, lower than a normal retrenchment payout. There was no talk of reemployment in a smaller capacity or reasons for the non-renewal (poor performance or health) -- clearly against the tripartite guidelines and the Reemployment Act, and possibly a case of disguised retrenchment. What recourse does he have?
