Any retail funds out there charge by high watermark fee structure? Or does no fund manager dare to use high watermark?

Usually for hedge funds and comes at a cost of higher management/performance fees. Most retail investors tend to go with passive/index funds which usually just tracks the performance on an index or benchmark so this is not very applicable.

Why is it in up markets fund managers are high beta, but in down markets sharpe ratios turn negative and then fees cause excess loss beyond ETFs? Does active management work when paying such high fees?
