With preschool-aged children (say 3-5 years) whose parents are going through a divorce, how will the court be able to tell which parent they'd want to live with since they can't express opinion?

Children of pre-school age will not be asked for their opinion on care & control. Where all things are equal, mothers of young children will be granted care & control as the Court recognizes the importance of the maternal bond on the emotional and psychological welfare of young children.
